Is CBD Legal in Florida? (CBD Laws in 2021)

IS CBD LEGAL IN FLORIDA?

As of 2014, CBD is legal in Florida. Lawmakers approved and legalized a low-THC CBD oil for qualifying medical marijuana patients that are registered in the state program. Florida’s first medical marijuana program made it possible (+ legal) for patients with cancer, seizures, terminal illness, and muscle spams to obtain a doctor’s prescription to purchase, obtain, and consume medical cannabis containing no more than 0.8% THC or 10% or more of CBD.

In 2018, via the Farm Bill, SB 1020 legalized hemp, with the law defining that a plant containing less than 0,3% THC is legal.

Florida has not yet set any limitations on how much CBD a person can possess.

WHAT IS CBD?

Let’s be honest, you’ve been wondering about CBD for a while now. You’ve scrolled through pages and pages of Google search results and there are still hundreds of thousands more to go, seeing no end in sight.

If you live in a state that has legalized marijuana, you might be seeing more holistic, all-natural remedies, like cannabidiol, popping up just about everywhere. I mean, everywhere. Even though you’re seeing it in stores, shops, and online and social media, you may still be wondering, what is it and how does it work.

Well, I’m here to help share with you the magic behind this wonderful herb that’s turning major heads. Cannabidiol is derived from the cannabis Sativa plant, also known as the hemp or marijuana plant. It is a non-psychoactive cannabinoid, meaning that it doesn’t elicit euphoric feelings. As a naturally-occurring compound frequently used in salves, creams, tinctures, and oils, it aims to provide feelings of calmness and relaxation. Unlike tetrahydrocannabinol (THC), this compound won’t get you “high” or “stoney bologney”.

WHAT IS THC?

THC is the medical short term for tetrahydrocannabinol. THC is the psychoactive compound derived from the cannabis plant. It is responsible for most of marijuana’s physiological effects.

When most people think of THC they think of “weed” or “Mary J”. THC is very different than CBD, in that it connects directly with cannabinoid receptors, thus, giving a “high” effect to users. THC attaches to these receptors activating them and affecting a user’s pleasure, movements, memory, thinking, and concentration.

THC may produce mind-altering effects in users, so if you’re wanting a “high-less” effect, CBD with 0.0% - 0.3% THC would be your best choice. THC stimulates cells in the brain to release dopamine, creating that “feel good” euphoria effect that users rave about. However, THC may have potential side effects in users that CBD users aren’t really looking for.

DO YOU NEED A MEDICAL CARD TO BUY CBD IN FLORIDA?

Currently, users must have a medical marijuana card (MMJ card) to purchase CBD oil in the state of Florida.

However, few may not know that Florida residents can buy legal CBD without an MMJ card too. Several companies, working under legal federal hemp legislation, manufacture high-quality CBD oils and products that are legal to purchase, sell, and ship to most, if not all, states in the USA.

Again, CBD containing less than 0.3% THC is legal in all 50 states at the federal level. Where things get a little gray, is on the state levels.

Although Florida is showing promise for being able to purchase high-quality and potent CBD oil safely and legally, make sure to keep up with the legal requirements and potential changes.

WILL CBD SHOW UP ON A DRUG TEST?

CBD may not show up on a drug test, according to a recent 2020 urinary pharmacokinetic cannabis study. In this study, researchers analyzed acute doses of pure CBD via oral ingestion and vape inhalation. Researchers found that pure CBD did not show positive on urine drug tests, using the current federal workplace drug testing guidelines.

However, there is no restriction when it comes to labeling and regulating the THC content in CBD products yet. Thus, a positive drug test is possible if there is greater than 0.3% THC in your CBD product.

Since CBD is the non-psychoactive component of the cannabis plant, it won’t exert a “high” in users.

Certain drugs will certainly show up in a drug test, especially when consumed in larger quantities. This includes THC from marijuana.

Given the fact that CBD oil comes from the cannabis plant family, some users may be concerned that they will fail a drug test. Although high-quality CBD oil derived from hemp has very low levels of THC, some CBD oil may contain higher levels depending on the variant of the plant. This is where trouble happens. If the CBD is hemp-derived with less than 0.3% THC, you may be “in the clear”.

HOW LONG DOES IT STAY IN YOUR SYSTEM, CAN YOU GET FIRED?

CBD can stay in your system for anywhere from 2 - 5 days. It can remain detectable in your body depending on several factors.

These factors may include:

Dosage

Frequency of use

User metabolism

Administration method

In the early 1990s, a study published in the Journal of Pharmacology and Biochemistry Behavior examined high doses of CBD and its concentration in the bloodstream. The study was performed over a six-week period, with participants taking 700 milligrams of CBD daily. After the six-week period of dosing ceased, the endocannabinoid levels in the blood remained “virtually undetectable” thereafter.

Thus, researchers suggested that the elimination of cannabidiol was estimated to be about 2 -5 days and this does not significantly differ between genders.

DOES CBD HELP WITH ANXIETY?

CBD may be able to help with anxiety.

Evidence from recent clinical studies has demonstrated that CBD may be a potential source for new medications for the treatment of anxiety disorders, with the involvement of the ECS.

A foundational study for the anti-anxiety effects of CBD was published in 1990. This rat study investigated the presence of anxiolytic properties in cannabidiol. Researchers randomized the rats’ doses including 2.5, 5.0, and 10.0 mg/kg of body weight. The results from the study suggested that cannabidiol can cause selective anxiolytic effects, within a limited range of doses.

Researchers concluded that CBD may cause various anti-anxiety effects, with a range of doses.

A large 2019 case series examined the role of CBD in anxiety and sleep. This study had 103 adult patients at a psychiatric clinic. In the first month of CBD treatment, 79.2% of patients had decreased anxiety scores and continued to remain decreased during the study’s duration.

CBD may hold promising benefits for anxiety-related disorders.

Recently published in Current Neuropharmacology, a 2020 review investigation examined the “entourage effect” of terpenes coupled with cannabinoids for the treatment of anxiety disorders.

This article reviewed the current literature surrounding cannabinoids. Researchers suggested that endocannabinoids have been shown to exert clinical efficacy in treating anxiety disorders.
